Terms of Service
Last updated 2026-10-06. Changes: first revision for Painted Shores; named the processors this build actually sends data to.
These terms are the agreement between you and PaintedApp, LLC, which runs Painted Shores. Buying from us, or using the site, means you accept them. If you do not, please do not order.
What you are buying
A Painted Shores piece is a chart of one year of tides at one NOAA tide station. You choose the station and the year; we compute every high and low water of that year from the station’s published harmonic constants and draw it in the style and on the background you chose. What you see on screen is what gets printed.
A chart is a portrait of the astronomical tide, the part the Moon and the Sun make. It is a prediction from published constants, never a forecast, and never navigation advice: wind, pressure, river flow and surge move the real water by amounts the chart does not contain. Do not rely on it for any decision about the water.
Your chart is computed, not generated by AI: every height on it is summed by our engine from NOAA’s published constants. The optional photographic backgrounds, the opening film and the room scenes were made with AI image tools, and the plate says so where one is used; the charts shown on this site are real engine output.
You must be 18 or older, or the age of majority where you live, to order.
Made to order
Every piece is computed and printed for your order alone. Nothing is held in stock and nothing can be resold. Check the station, the year and the words on the plate carefully before you pay. Your order goes to the printer within minutes of payment, so a personalised piece cannot be cancelled or returned once it is under way, except where the fault is ours or the law says otherwise. The refunds page sets out what we do when something goes wrong.
If something arrives wrong
If your piece arrives damaged, defective, or not what you ordered, write to us within 30 days of delivery with a photograph and we will remake it or refund you. That is our own promise and it sits on top of your statutory rights, which nothing here reduces.
Your words, your rights
The title and dedication you put on the plate stay yours. You grant us only what we need to compute, print, and deliver your order. There are no uploads here: you give us a station, a year, a few words and an email, never a photograph.
Your purchase licenses the piece for personal use: hang it, gift it, photograph it. It does not transfer copyright in our artwork or templates, and it does not license commercial use, resale, or merchandise. If you want a commercial arrangement, write to us and ask.
Fair use of the site
Please do not scrape the site, resell access to it, attempt to defeat rate limits, or use it to produce anything unlawful, including titles or dedications that use someone else’s trademark or impersonate a real person. We may decline or refund any order at our discretion.
The honest limits
We compute each chart from NOAA’s published constants and print on archival stock. Even so: screens and paper differ, a curve drawn at poster scale is legible rather than millimetre-exact, and the real water carries weather the constants cannot. A chart is a work of art built on real tidal arithmetic, not a scientific instrument, and it must not be relied on for navigation, anchoring, swimming, timing, or any decision that matters. It predicts the astronomical tide; it never forecasts the sea.
The site and everything on it are provided as they are, without warranties of any kind. To the fullest extent the law allows, our total liability for any claim arising out of an order or these terms will not exceed what you paid for the order it concerns, and we are not liable for indirect or consequential loss. Nothing here limits liability that cannot be limited by law.
Prices and payment
Prices are shown at checkout in US dollars and charged by Stripe; we never see or store your card details. Shipping is a flat rate per item, shown at checkout before you pay. Prodigi prints and ships each piece. Import duties, where they apply, are the recipient’s responsibility.
Governing law
These terms are governed by the laws of the State of Oregon, United States, without regard to its conflict-of-laws rules, and disputes will be heard there — except where consumer-protection law where you live gives you the right to bring proceedings in your own country. Before filing anything, please write to us so we can try to settle it directly.
Changes
We may update these terms. The date at the top always says when. Orders are governed by the terms in force when you placed them.
